These terms apply to bookings made directly with Highwayman Tours through our website, by email, telephone, WhatsApp or another direct booking method. Please read them before making a booking.
When you make a booking, you confirm that you have read and accepted these terms on behalf of yourself and everyone included in your booking.
Highwayman Tours is operated by Kestrel Webster and provides private driven tours from York across Yorkshire.
A booking is confirmed when Highwayman Tours has accepted the booking and the required deposit or full payment has been received.
The person making the booking must be at least 18 years old and is responsible for:

The price shown at the time of booking applies to the private group rather than to each passenger, unless the booking page clearly states otherwise.
Direct bookings may normally be secured by either:
Unless agreed otherwise in writing, any outstanding balance must be paid no later than 24 hours before the tour begins.
If payment is not received by the deadline, Highwayman Tours may treat the booking as cancelled by the customer. Any cancellation charge will be subject to section 8 of these terms.
The booking page or written quotation will explain the principal features of the tour and what is included in the price.
Unless expressly stated otherwise, the price includes:
Admission charges, meals, drinks, accommodation, personal purchases and other third-party expenses are not included unless the booking description or written confirmation specifically says they are included.
Tour descriptions and proposed itineraries are provided as a guide. Highwayman Tours may make reasonable changes because of traffic, weather, road closures, attraction availability, safety concerns or circumstances outside our reasonable control.
Where possible, a suitable alternative stop or route will be offered. A reasonable itinerary change that does not substantially reduce the overall service will not normally entitle the customer to a refund.
Collection and return times are approximate because road conditions cannot be guaranteed. If Highwayman Tours arrives late, reasonable efforts will be made to provide the agreed tour duration or an appropriate alternative.
Requests to change a date, collection point or itinerary are subject to availability and practical feasibility.
Where at least seven clear days’ notice is provided, Highwayman Tours will normally allow one change of date without an additional administration charge. Any unrecoverable third-party costs or price difference will remain payable by the customer.
Changes requested within seven days of the tour are discretionary and may be treated as a cancellation and new booking.
Customers are responsible for:
Highwayman Tours may refuse or end a tour where a customer’s behaviour is threatening, abusive, unlawful, seriously disruptive or creates a safety risk. No refund will normally be provided where the tour is ended for one of these reasons.
Cancellations must be communicated by email, telephone or WhatsApp and take effect when received by Highwayman Tours.
Payments will normally be refunded, less any non-recoverable third-party costs that were incurred specifically for the booking with the customer’s agreement.
Highwayman Tours may retain the 20% deposit or charge up to 20% of the booking price to reflect the reservation of the date, planning already undertaken and the reduced opportunity to accept another booking.
Up to 100% of the booking price may be charged where the cancellation prevents the date from being resold.
If the customer does not attend or cannot be contacted at the agreed collection point, the booking may be treated as a cancellation with less than 48 hours’ notice.
Highwayman Tours will take reasonable steps to reduce its losses, including attempting to resell the date where practical. Any cancellation charge will not exceed the loss reasonably resulting from the cancellation, after accounting for costs saved or income received from a replacement booking.
Customer illness, disrupted travel or changes of personal circumstances are subject to the same cancellation provisions. Customers are encouraged to obtain suitable travel insurance.
Highwayman Tours may cancel or reschedule a tour because of illness, vehicle problems, unsafe conditions, severe weather, road closures or another circumstance that prevents the tour from being delivered safely and properly.
If Highwayman Tours cancels the complete tour, the customer will be offered:
Highwayman Tours will not be responsible for separate accommodation, transport, admission or other arrangements that the customer booked independently. This does not limit any rights the customer has under applicable law.
Tours will normally continue in changeable or wet weather where it remains safe and practical to do so.
Where an attraction, road or planned stop becomes unavailable, Highwayman Tours may adjust the route or provide a reasonable alternative.
If circumstances outside either party’s reasonable control make the entire tour impossible or unsafe, Highwayman Tours will discuss rescheduling, refunding or another fair solution based on the circumstances and applicable law.
Children must be accompanied and supervised by a responsible adult. Customers must provide accurate passenger ages and notify Highwayman Tours in advance if a child seat or other equipment may be required.
Bookings must not exceed the confirmed passenger capacity of the vehicle.
Highwayman Tours will make reasonable efforts to accommodate accessibility and mobility requirements. However, the vehicle, terrain and historic locations may not be suitable for every requirement.
Customers should discuss relevant needs before booking so that the suitability of the vehicle and itinerary can be assessed honestly.
Storage space is limited. Customers should discuss substantial luggage, mobility equipment or unusual items before booking.
Customers remain responsible for their personal belongings. Highwayman Tours is not responsible for loss or damage unless caused by a failure to exercise reasonable care.
Attractions, restaurants, railway services and other third-party providers operate independently and may change their opening hours, prices or availability without notice.
Highwayman Tours is not responsible for the independent acts or omissions of a third party, but will provide reasonable assistance if a problem affects the planned tour.
Bookings made through Airbnb, Viator, GetYourGuide or another third-party platform may also be governed by that platform’s payment, amendment, cancellation and refund terms.
Where platform terms apply to a transaction, they will take priority over these terms to the extent of any direct inconsistency concerning that platform booking.
Highwayman Tours will provide services with reasonable care and skill. Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Nothing in these terms affects the customer’s statutory consumer rights.
Customers should raise any concern as soon as possible so that Highwayman Tours has a reasonable opportunity to address it.
Complaints after the tour should be sent to keswebster@highwaymantours.com with the booking reference and relevant details.
Personal information is handled in accordance with the Highwayman Tours Privacy Policy. The Privacy Policy should be read alongside these booking terms.
These terms are governed by the laws of England and Wales. Customers retain any mandatory rights they have to bring proceedings in another appropriate part of the United Kingdom.
Highwayman Tours may update these terms from time to time. The version applying to a booking will normally be the version in effect when that booking was made, unless a change is required by law or expressly agreed with the customer.
